Social Security Disability Utah

What is Social Security Disability (SSDI)?

Are you unable to work due to a disability or impairment? If so, we can help you receive Social Security Disability Utah Income or SSDI. If you qualify, SSDI will provide you with monthly income as long as you meet the requirements. Our experienced Utah Social Disability attorneys can help you determine if you qualify.

Social Security Disability Insurance is a federal insurance program that is funded through pay-roll taxes. SSDI was put into place to ensure that those who are unable to be employed due to a disability are provided with monthly income supplements as long as they meet the requirements in place. Depending on a person’s injury, SSDI can either be distributed for a short period of time or permanently.

What Are SSDI Basic Qualifications?

In order for you to qualify for Social Security benefits, there is no minimum age requirement for you to meet, but there are certain work requirements that need to be met in order for you to have your claim approved.

The work requirements that are needed vary depending on the individual’s age. Each year you have the ability to earn up 4 credits. The rules for how many credits you need to qualify for a disability claim depending on your age are as follows:

          • Before age 24–You may qualify if you have 6 credits earned in the 3-year period ending when your disability starts.
          • Age 24 to 31–You may qualify if you have credit for working half the time between age 21 and the time you become disabled. For example, if you become disabled at age 27, you would need credit for 3 years of work (12 credits) out of the past 6 years (between ages 21 and 27).
          • Age 31 or older–In general, you need to have the number of work credits shown in the chart below. Unless you are blind, you must have earned at least 20 of the credits in the 10 years immediately before you became disabled.

What If My SSDI Application Is or Has Been Denied?

If your SSDI claim is or has been denied you have the ability to appeal it. Often times an applicant has their best chance of winning their claim during the appeals process where they can have their case heard before an administrative hearing. During the appeals process your case is taken in front of an Administrative Law Judge where you will be sworn in under oath. A medical expert may also be there to testify about your condition.

Social Security regulations can be complicated and hard to comprehend. We have represented Social Security claimants in 13 different states successfully. If your claim is denied, our attorneys are here to help assist you in getting your claim approved.
