What is The Work Experience Requirement?

Do I Qualify for Social Security Disability Income (SSDI) benefits is a question that our attorneys are frequently asked. In order to qualify for SSDI you will need to meet certain work experiences. Work requirements vary depending on the applicant’s age. For younger applicants, work requirements will differ from older applicants. For example, if you have paid your FICA taxes and can show that you have worked for half of your life, including 2 years prior to your disability, you will likely meet the work experience requirement.  After you have met the work experience requirements, you must be able to show that you have a disability or impairment that prevents you from continuing to work.

What is The Persistent or Continuous Disability Requirement?

After meeting the work experience requirement, You must show that your disability keeps you from working for at least a minimum 12 months. You must also prove that your disability prohibits you from working at another job in the workforce. Your disability can be mental, physical, or a chronic illness.

Mental Disabilities:

A number of mental disabilities may meet the disability requirements, including:

Physical Disabilities Examples:

When trying to get your SSDI claim approved you must be able to show that you not only have a physically disability, but you must also be able to show that the disability is preventing you from work for at least 12 months. It is also important that you prove that your disability is hindering your ability to not only work at previous jobs, but also any other job in the workforce. Successful applications include:

Chronic Illness Examples:

Social Security sees a lot of claims for back pains and chronic problems, but it approves few applications. These conditions can be extremely painful and frustrating, but in order to qualify for benefits you must show that your pain is so severe that it has prohibited you from working.

To determine if your chronic pain is severe enough, Social Security will look over your medical records, ask a doctors opinion, evaluate if the pain affects your daily activities, and what treatments you have tried. If it is established that your back pain is severe enough to prohibit you from working, your claim will be approved.
